EnergyConnect

1. Introduction

Welcome to EnergyConnect, a platform dedicated to connecting project holders with certified experts in energy efficiency assessments, including CECB, CECB+, Minergie certifications, and thermal assessments. These Terms of Use (ToU) govern your use of our platform and services.

2. Acceptance of Terms

By registering and using EnergyConnect, you acknowledge that you have read, understood, and agreed to be bound by these ToU. If you do not accept these terms, please refrain from using our services.

3. User Accounts

3.1 Account Creation

To use EnergyConnect, both project holders and service providers must create an account by providing accurate and up-to-date information.

3.2 Account Responsibility

Users are responsible for the security of their accounts, including passwords and all activities that occur under their accounts. In case of unauthorized access, users must inform EnergyConnect immediately.

4. Usage of the Platform

4.1 Project Posting

  • Project holders can post project details, which must be accurate and truthful.
  • EnergyConnect reserves the right to remove any misleading or inappropriate content.

4.2 Service Offers

  • Service providers can browse available projects and submit offers.
  • Offers must comply with applicable laws and accurately reflect the service provided.

4.3 Selection Process

  • Project holders are free to select the most suitable offer based on price, description, and service provider reputation.
  • EnergyConnect does not intervene in the selection process.

4.4 Transactions & Payment System

  • Payments are securely processed via WooPayments, supporting major payment methods including credit cards, Apple Pay, Google Pay, Mastercard, and Visa.
  • A 14% fee (TTC) is deducted from the service provider’s earnings for platform usage.
  • Project holders pay a fixed CHF 20 fee (TTC) upon accepting an offer.
  • An 8.1% VAT is applied at checkout.

4.5 Funds Handling & Service Completion

  • Payments are held by EnergyConnect in a secure account until the service is marked as completed by the project holder.
  • It is the service provider’s responsibility to ensure that the project holder confirms the completion.
  • Once confirmed, payments are processed to the service provider’s designated bank account within one week.

5. Rights and Obligations

5.1 EnergyConnect’s Rights

  • We reserve the right to modify, suspend, or discontinue any part of the platform at any time.
  • We may remove content that violates these ToU.

5.2 User Responsibilities

  • Users agree not to use the platform for illegal, fraudulent, or unauthorized purposes.
  • Any attempt to bypass platform fees, manipulate transactions, or misrepresent services may result in account suspension.

6. Disputes & Conflict Resolution

6.1 Handling Disputes

  • If a dispute arises, either party (project holder or service provider) may submit a complaint through the designated dispute system or via email.
  • EnergyConnect reviews disputes on a case-by-case basis and may issue refunds if justified.
  • Disputes must be reported within 7 days of service completion.

6.2 Arbitration & Account Suspension

  • EnergyConnect reserves the right to suspend or close accounts due to fraud, multiple complaints, or ToU violations.
  • Funds may be frozen until the dispute is resolved.
  • If funds are legitimately owed to a user, refunds will be processed accordingly.

7. Privacy and Data Protection

  • We comply with the Swiss Data Protection Law and store user data securely.
  • Banking details are stored only for transaction purposes, secured via Infomaniak (Switzerland).
  • Payment processing is handled by WooPayments, and we do not share user data with third parties unless required by law.

8. Intellectual Property

All content on EnergyConnect, including text, graphics, logos, and service descriptions, remains the exclusive property of EnergyConnect or respective users. Unauthorized use is strictly prohibited.

9. Limitation of Liability

  • EnergyConnect is not responsible for the quality, accuracy, or timeliness of services provided by service providers.
  • Project holders are responsible for choosing their service provider based on the provided description, price, and communication.
  • EnergyConnect is not liable for any damages resulting from transactions between users.

10. Changes to the Terms of Use

We reserve the right to update these ToU at any time. Changes take effect immediately upon publication on the platform. Continued use of the platform constitutes acceptance of the updated terms.
