1. Introduction

Welcome to energyConnect, the digital platform operated by energyConnect SNC (UID: CHE‑169.218.354, based in 3960 Sierre, Switzerland), facilitating the connection between project holders and certified service providers in energy efficiency, including CECB, CECB+, Minergie certifications, thermal assessments, and related services.

2. Acceptance of Terms

By accessing or registering on energyConnect, you confirm that you have read, understood, and accepted these Terms of Use in full. If you do not agree, please do not use the platform.

3. User Accounts

3.1 Account Registration

To access platform features, both project holders and service providers must register with accurate and up-to-date personal and professional information.

3.2 Account Responsibility

Each user is responsible for maintaining the confidentiality of their login credentials and activities under their account. Unauthorized access must be reported immediately to energyConnect.

4. Platform Usage

4.1 Project Posting

Project holders may post project requests specifying their needs. All information provided must be truthful and accurate. energyConnect reserves the right to moderate or remove content.

4.2 Offers from Service Providers

Service providers may submit offers including service descriptions, prices, and proposed timelines. Offers must comply with applicable laws and must reflect reality. All offers and prices submitted via the platform are considered exclusive of VAT (HT). VAT will be applied separately where required.

4.3 Order Validation and Invoicing

Once an offer is accepted by a project holder, a service order is validated on the platform, creating a direct contractual relationship between the project holder and the service provider. energyConnect does not process payments or issue invoices on behalf of providers.

4.4 Service Timeline

The delivery timeline is defined in the offer submitted by the service provider and validated by the project holder.

5. Commissions & Billing

5.1 Commission Structure

energyConnect applies a service commission to each offer accepted via the platform, payable by the service provider. The commission is calculated as follows:
  • Up to CHF 1,000: 9% (excl. VAT)
  • Above CHF 1,000: fixed amount based on tiered pricing (displayed during offer submission)
All commissions are exclusive of VAT. Swiss VAT (8.1%) is added upon invoicing.

5.2 Commission Invoicing

Commission invoices are issued after service completion with a 30-day payment term. energyConnect reserves the right to invoice earlier if deemed appropriate. Late payment may result in account suspension. In addition, energyConnect reserves the right to initiate legal proceedings for unpaid invoices, in collaboration with the competent municipal, cantonal, or federal authorities of Switzerland.

6. Non-Circumvention Clause

energyConnect takes non-circumvention seriously. Any attempt to bypass the platform by establishing direct contact between a project holder and a provider after a match via energyConnect is strictly prohibited. Violations may result in account termination and legal action, including financial penalties.

7. Rights and Obligations

7.1 Rights of energyConnect

We reserve the right to modify, suspend, or terminate any platform feature or user account at any time.

7.2 User Responsibilities

Users must not engage in fraudulent or unlawful activity, nor bypass the platform’s commission system.

8. Dispute Resolution

8.1 Reporting

Disputes can be reported via the platform or to info@energyconnect.ch. We investigate and may assist with resolution.

8.2 Account and Fund Handling

energyConnect may freeze commissions or suspend accounts during dispute resolution.

9. Data Protection & Confidentiality

We comply with Swiss data protection laws. User data is securely stored via Infomaniak. Payment data is processed via WooPayments or trusted providers. Data is not shared unless legally required.

10. Intellectual Property

All content (text, design, code, visuals) belongs to energyConnect or its users. Reproduction or misuse is prohibited.

11. Limitation of Liability

energyConnect is not liable for the quality or outcome of services. Users bear sole responsibility for selection and payment of services.

12. Changes to the Terms

These ToU may be updated without notice. Continued use of the platform indicates acceptance of the latest version.
